Police on Thursday raided a 69传媒 CBD store and arrested the owner for selling THC products above the legal limit in Kansas.
A Riley 69传媒 Police Department spokeswoman said officers executed a search warrant at CBD American Shaman in Aggieville after recently citing for possession of marijuana many people who bought what they believed were legal products from local businesses.
They arrested 46-year-old Donald Ince of 69传媒 shortly after 10 a.m. and charged him with three counts of distribution of less than 25 grams of marijuana and one count of failure to appear. Ince is out of jail on a $15,060 bond.
Police said people cited for possession of illegal products bought from local businesses were confused because they were under the impression the products were legal in Kansas. Some THC products in Kansas are legal, provided they69传媒檙e derived from industrial hemp.
The Kansas Industrial Hemp Act defines industrial hemp as any part of the cannabis plant containing a delta-9 tetrahydrocannabinol, or THC, concentration at or below 0.3% on a dry-weight basis. Kansas law classifies all products above that threshold, regardless of where they69传媒檙e purchased, as marijuana, a controlled substance it69传媒檚 illegal to distribute or possess.
The RCPD spokeswoman said the investigation into illegal products sold at local businesses is ongoing.
Police urged consumers to make sure the products they buy comply with state law and businesses to do the same with the products they sell. Businesses selling products above the legal THC limit could face criminal charges.
In Kansas, six hemp products are illegal to manufacture, market, sell or distribute, including cigarettes, cigars, smokeless materials, teas and vape liquids or gases containing industrial hemp.
Kansas is one of a handful of states in which both recreational and medical marijuana are illegal. Medical use is legal in 39 states, and recreational use is legal in 24.
